~OORESV~'LLE BOARD OF ZONZNG APPE~I,S <br /> FTNDZNG8 OF F~CT <br /> <br /> Comes now Roger Caperton, Arvin Hopkins, and Donald Stafford, <br />and petition the Court for a Variance at 460 Town Center Road, <br />commonly known as Lot Number 4, Section 2, as per plat recorded in <br />Book 368, Page 450 in the Recorders office, and request a variance <br />from the development standards for a sign reducing the setback from <br />60 feet to 22 feet. The Board of Zoning Appeals having found <br />notices to be in order and having held a public hearing now finds <br />pursuant to I.C. 36-7-4-918.5: <br /> <br /> 1. That the approval of the variance will not be injurious to <br />the public health, safety, morals, and general welfare of the <br />community in that the sign is on a four lane highway and is <br />consistent with other commercial signs located in this area. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner since this sign is consistent with the <br />area and is in a commercial area on a four lane highway. <br /> <br /> 3. That the strict application of the terms of the zoning <br /> ordinance would result in practical difficulties in the use of this <br /> property by having the sign placed 60 feet back which would limit <br /> <br /> <br />
