MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having reviewed the <br />variance request filed by Mark A. Ferrill and Charolette M. <br />Ferrill of 510 Keller Hill Road, Mooresville, Indiana requesting a <br />variance from the development standards of the Town of <br />Mooresville's Zoning Ordinance requesting permission to put a sign <br />twenty square feet in size to advertise a daycare use on the <br />property zoned residential. The Mooresville Board of Zoning <br />Appeals having heard evidence on the Petition filed by the <br />Ferrills now makes the following findings of fact pursuant to I.C. <br />36-7-4-9]8.5: <br /> ]. That the approval of the variance will not be injurious to <br /> the public health, safety, morals, and general welfare of the <br /> community in that the requested variance does not propose any <br /> public health hazard or threat to the general community. <br /> 2. That the use and value of the area adjacent to the <br /> property would be affected in a substantially adverse manner due <br /> to the size of the sign reflecting a business type use in a <br /> residential area thus changing the character of the residential <br /> use and affecting property values. <br /> 3. That the strict application of the terms of the zoning <br /> ordinance would not result in practical difficulties in the use of <br /> the property in that there is no evidence that the property cannot <br /> satisfactorily be used as a residential use and is currently being <br /> used as a family dwelling. <br /> <br /> That the Mooresville Board of Zoning Appeals adopts these <br /> findings of facts and denies the variance requested at the meeting <br /> <br />of August 18, 1993. <br /> <br />MOORESVILLE BOARD OF ZONING APPEALS <br />S~teve Oschman, Chairman <br /> <br /> <br />
