FINDINGS OF FACT <br /> <br /> Mark and Janean Untersinger having filed a a request for a <br />variance from the development standards to allow a minimum lot <br />square footage of Eleven Thousand Five Hundred Square Feet in a B- <br />2 classification which is less than the required development <br />standard of Twelve Thousand Five Hundred Square Feet in a B-2 <br />classification on Lot Number 3 of Springmill Court, an addition to <br />the Town of Mooresville, recorded in Deed Record 306, Page 144 of <br />the Office of the Recorder of Morgan County, Indiana. The Board <br />of Zoning Appeals having heard evidence on April 21, ?993 now <br />finds pursuant to I.C. 36-7-4-9?8.5: <br /> <br /> 2. That the approval will not be injurious to the public <br />health, safety, morals and general welfare of the community due to <br />the existing building on Lot Number Two and the proposed expansion <br /> <br />of this building being compatible. <br /> <br /> 2. That the use and value of the <br />property included in the variance will <br /> <br />area adjacent to the <br />not be affected in a <br /> <br />substantially adverse manner due to the existing structure and <br />it's proposed addition. <br /> <br /> 3. That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use of the <br />properties restricting any expansion of the building on Lot Two <br />and appropriate use of Lot 3. <br /> <br /> That the Mooresville Board of Zoning Appeals unanimously <br /> <br /> <br />
