FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals having reviewed the <br />Petition for variance filed by Caperton Development Group on Lot <br />26 of Crafton Meadows requesting a variance from the development <br />standards on Lot 26 on the side yard from six feet to five feet on <br />both sides now makes the following findings of fact pursuant to <br />Indiana Code 36-7-4-918.5: <br /> <br /> 1. That the approval will not be injurious to the public <br />health, safety, morals, and general welfare of the community in <br />this specific instance due to the location of the home and the one <br />adjoining property already constructed and the general nature and <br />topography of the area. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance would not be affected in any <br />substantially adverse manner with a one foot change on the side <br />set-backs in this instance due to the general topography. <br /> <br /> 3. That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use of the <br />property for construction. <br /> <br /> That the Mooresville Board of Zoning Appeals unanimously <br /> grants this variance this 21st day of April, 1993. <br /> <br /> <br />
