MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />FINDINGS OF FACT <br /> <br />A petition for a variance from the development standards of <br /> <br />the Mooresville Zoning Ordinance having been filed by Boyd and <br /> <br />Marilyn Head concerning the width to depth ratio on lots 2, 3, 4 <br /> <br />and 5 of Castle Cove <br /> <br />; along with a variance for sidewalks <br /> <br />adjoining Greencastle Road and a hearing being held the 17th day <br /> <br />of June, 1992, by the Mooresville Board of Zoning Appeals and the <br /> <br />Board now makes the following findings of fact pursuant to I.C. <br /> <br />36-7-4-918.5: <br /> <br /> 1. That the approval of this variance from the width to <br />depth ratio of the town's ordinance would not be injurious to the <br />public health, safety, morals, and general welfare of the <br />community due to the size of this subdivision, its proximity to <br />any other similar uses and the lay of the land. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance will not be affected in a <br />substantially adverse manner due to this variation of the width to <br />depth ratio. <br /> <br /> 3. That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the <br />subdivision of this ground due to the lake and existing <br />residential structure. <br /> <br />The Board of Zoning Appeals making the following findings of <br /> <br />fact pursuant to I. C. 36-7-4-918.5 as to the request for a <br /> <br />variance from the development standards for sidewalks: <br /> <br /> 1. That the approval would not be injurious to the public <br />health, safety, morals and general welfare of the community due to <br />the fact that there are no adjoining sidewalks on Greencastle Road <br />and the implementation of this singular stretch of sidewalks could <br />create a danger to those persons attempting to use it. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner since there are no other sidewalks in <br />the area. <br /> <br /> <br />
