MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> <br /> The Mooresville Board of Zoning Appeals heard the request for <br />a variance from the development standards on the application of <br />Environmental Development Corporation concerning the lot size for <br />lots 81, 84, 85, 86, 87, 88, 93 and 94 along with a request for a <br />set back on the building line for lot 82 in Rooker Trace <br />Subdivision, Section 3 as per plat recorded in the Recorder's <br />Office of Morgan County, Indiana; the public hearing being held <br />June 17, 1992. Pursuant to I.C. 36-7-4-918.5 the Mooresville <br />Board of Zoning Appeals makes the following findings of fact as to <br />the request for a variance from development standards concerning <br />lot size: <br /> <br /> 1. That the approval would not be injurious to the public <br />health, safety, morals and general welfare of the community due to <br />the size variance being only slightly less than the ordinance <br />requires and the lay of the land making this development more <br />suitable as presented with the reduced size lots as set out <br />above. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance will not be affected in a <br />substantially adverse manner due to the minor nature in the <br />reduction of the size of the lots and the manner in which these <br />lots blend into the total plat. <br /> <br /> 3. That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use of the <br />property due to the lay of the land as platted. <br /> <br /> That the Mooresville Board of Zoning Appeals makes the <br />following findings of fact pursuant to I.C. 36-7-4-918.5 <br />concerning the request for variance from the development standards <br />on lot 82 of Rooker Trace Subdivision, Section 3 as per plat <br />recorded in the Office of the Recorder of Morgan County, Indiana, <br /> <br /> <br />
