FINDINGS OF FACT <br /> <br />Comes now Kenneth Johnson, contract purchaser, and Marilyn A. <br /> <br />Scott, contract owner, of the real property with a common address <br /> <br />of 312 1/2 Landersdale Road, Mooresville, Indiana, more <br /> <br />particularly described in the attached Exhibit "A" which is <br /> <br />attached hereto and made a part hereof, and the Board of Zoning <br /> <br />Appeals, having heard the petition for the use as a body shop by <br /> <br />Kenneth Johnson on said property which is zoned A-l, Agricultural <br /> <br />District, the Board of Zoning Appeals now finds that pursuant to <br /> <br />Indiana Code 36-7-4-918.4: <br /> <br />1. The approval of this variance would not be injurious to <br />the public health, safety, morals and general welfare of the <br />community due to the location of the structure on the <br />property and the nature of the use. <br /> <br />2. The use and value of the area adjacent to the property <br />included in the variance would not be affected in a <br />substantially adverse manner due to the enclosed nature of <br />the use. <br /> <br />3. That the need for the variance arises from some condition <br />peculiar to the property involved due to the size of the <br />property and the lack of feasibility to use said ground for <br />any agricultural use. <br /> <br />4. That the strict application of the terms of the zoning <br />ordinance would constitute an unnecessary hardship if applied <br />to the property for which the variance is sought due to the <br />size and location of the property. <br /> <br />5. That the approval does not interfere substantially with <br />the comprehensive plan due to the enclosed nature of the <br />variance. <br /> <br />The Mooresville Board of Zoning Appeals now grants the <br /> <br />variance for the use of a body shop in the existing structure on <br /> <br />said property only and further states that there shall be no <br /> <br />outside storage of parts or unlicensed vehicles on the outside of <br /> <br /> <br />
