MOORESVILLE BOARD OF ZONING APPEALS
FINDINGS OF FACT

The Mooresville Board of Zoning Appeals, having reviewed the

application for a variance requested by Mary Susan Moore at its
meeting of March 18, 1992, said variance requesting that the

development standard of lot width to depth ratio of 2.5 to 1 to be

changed to allow a 150 foot by 667 foot lot on her minor plat for

Lot 4 which is located in the east half of Section 10, Township 13

North, Range 1 East, Brown Township, Morgan County, Indiana.

The Board now makes the following findings of fact pursuant

to Indiana Code 36-7-4-918.5:

1. That the approval of the variance would not be injurious
to the public health, safety, morals, and general welfare of
the community due to the fact that said ground on the other
sides of said parcel has been sold and due to the drainage
and water located on said lot, it would not be feasible to
subdivide it into smaller tracts, making it more beneficial
to keep the lot as one.

2. That the use and value of the area adjacent to the
property included in the variance will not be affected in a
substantially adverse manner due to the fact that any failure
to keep this as one lot would make the use of said ground
impossible to appropriately develop, hurting the adjoining
property owners.

3. That the strict application of the terms of the zoning
ordinance would result in practical difficulties in the use
of the property, more particularly, the development of said
ground due to the terrain and existing development
surrounding it.

Charles McGuire, Pres'

~V~rn KimmeI,-Secretar~ ~ Dated: ~-/~- ~Z

This instrument prepared by Tir~thy C. C0rrens, Attorney-at-Law.
