MOORESVILLE BOARD OF ZONING APPEALS <br /> SPECIAL EXCEPTION FINDINGS <br /> <br />An application for a special exception having been filed by <br /> <br />Billy Ferguson and Janet Ferguson to allow for the following <br /> <br />special uses in a B-3 zoning classification, more particularly, <br /> <br />automobile sales and automobile repair and trailer sales and <br /> <br />trailer repair on the following described ground: <br /> <br />Common address: 9335 S. State Road 67, Camby, Indiana <br /> <br />Legal description: See attached Exhibit "A" <br /> <br />And the Mooresville Board of Zoning Appeals having received notice <br /> <br />from the Mooresville Plan Commission that the proposed special <br /> <br />exception would not affect the master land use plan now makes the <br /> <br />following findings pursuant to Chapter 5 of the Mooresville Zoning <br /> <br />Ordinance: <br /> <br />1. That the establishment, maintenance, or operation of the <br />special exception will not be detrimental to or endanger the <br />public health, safety, morals, or general welfare of the <br />community since the adjoining uses are compatible with this <br />and said use has been conducted on the grounds prior to the <br />enactment of the Mooresville Zoning Ordinance. <br /> <br />2. That the special exception will not be injurious to the <br />use and enjoyment of other properties in the immediate <br />vacinity for the purposes already permitted in that it is a <br />compatible use due to the location of the property and <br />adjoining uses and the proximity to State Road 67. <br /> <br />3. That the establishment of the special exception will not <br />impede or substantially alter the normal orderly development <br />and improvement of the surrounding property for uses <br />permitted in the district in that this is a compatible use. <br /> <br />4. That adequate utilities, access roads, drainage and other <br />necessary facilities have been or are being provided. <br /> <br />5. That adequate measures have been or will be taken to <br />provide ingress and egress so designed as to minimize traffic <br />congestion on the public roads, with adequate access being in <br />existence. <br /> <br /> <br />
