MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> FINDINGS OF FACT <br /> <br /> Mooresville Board of Zoning Appeals having heard the variance <br />request of the Mooresville Post 1~11 Veterans of Foreign Wars <br />concerning the real property located at 23 E. South Street, <br />Mooresville, Indiana, more particularly described as the east one- <br />half of Lot #2, Block 64 in Moore's Fourth Addition to the Civil <br />Town of Mooresville, Morgan County, Indiana, requesting a variance <br />from the current residential use to allow the property to be used <br />as a parking lot and the Board of Zoning Appeals now makes the <br />following findings of fact and action pursuant to I.C. 36-7-4- <br />9~8.4: <br /> <br /> ~. That the approval of the variance will not be injurious <br /> to the public health, safety, morals, and general welfare of <br /> the community in that it is a consistent use to the area. <br /> <br /> 2. That the use and value of the area adjacent to the <br /> property included in the variance will not be affected in a <br /> substantially adverse manner in that said use is not <br /> inconsistent with the surrounding area. <br /> <br /> 3. That the need for the variance arises from some condition <br /> peculiar to the property involved, namely, to the shape of <br /> the property, and in particular, its width. <br /> <br /> 4. That the strict application of the terms of the zoning <br /> ordinance will constitute an unnecessary hardship if applied <br /> to the property for the variance which is sought due to the <br /> shape of the property. <br /> <br /> 5. That the approval does not interfere substantially with <br /> the comprehensive plan adopted under the 500 series. <br /> <br /> The Board having reviewed the variance now grants the <br />variance subject to the following restrictions allowing the <br />property to be used as a parking lot only and restricting the use <br /> <br />as follows: <br /> <br /> <br />
