<br />" <br /> <br />square foot homes and they were nice size if they were two bedroom and if they go to <br />three bedrooms that makes a really small living area but if the customer went to 1500 <br />square feet there were three bedrooms. Mr. Holloway commented they were leaving <br />everything the same but only requesting a change in the Cambridge section to 1400 <br />square feet on 60 percent of the lots and the homes would still be in the range of <br />$180,000. Commissioner Crouch commented he thought they should let them have 60 <br />percent at 1400 square foot in Cambridge Village because if the commission tightened up <br />things more they could see the whole project go. Mr. Holloway agreed the project could <br />be in jeopardy if the floor size was not lowered. Commissioner McGuire said he didn't <br />think it would have much affect on how it looks and if you drive down the street you <br />can't tell if the home is 1400 square feet or 1600 square feet just by looking at the house. <br />There were no comments or questions from the audience. Commissioner Crouch made a <br />motion, a second by Commissioner McGuire to approve the Cambridge Village Section <br />at 60 percent oflots at 1400 square feet. Motion carried 6-0. Mr. Holloway said they <br />would be appearing at the second meeting in February of the Mooresville Town Council. <br /> <br />r <br /> <br />Next on the agenda was the Village at Heartland Crossing with a final plat approval, <br />represented by Attorney Foley. This item was tabled from the December meeting. <br /> <br />Attorney Tim Currens commented that at the last meeting the commission had asked him <br />to look at a couple of issues, one was whether there was a time limit limitation on the <br />proceeding with the development. He had pulled the old plan commission minutes, the <br />commissioner's minutes, and the old county ordinance to see if the PUD and the rezoning <br />went together simultaneously and he believes there was no time limitation. The other <br />issue was the substantial change issue and looking at the Town's ordinance and he <br />believes maybe the only change would be the roads. The issue there would be whether or <br />not the cul-de-sacs represent a substantial change versus just having a straight thru <br />because basically they are in the same location. The third item that had just came up in <br />the interim time period was the issue of certain covenants that the petitioners agreed if <br />they were to keep the plan as submitted would agree to a covenant there would be no <br />vinyl siding permitted, no slab construction for the main portion of the house, anyone <br />story home less than 1800 square feet shall be constructed on a basement, all two story <br />homes shall be a minimum of 2200 square feet. This would be only for this new section <br />and would not apply to any of those additions that go on out east. Attorney Currens said <br />his only concern was that this should be a part of the actual plat itself, not in the <br />declarations and covenants, but actually placed on the plat. He said the reason for this is <br />because then it could not be changed without coming back for an amendment and our <br />building inspector can see if something is not in compliance he can red tag the <br />construction if it has started or deny the permit. Attorney Currens said he had reviewed <br />the plat and these items are written on there as he had requested. So, the options at this <br />point are to either approve the plat with those covenants in it, to say there has been a <br />substantial change, I guess their options are to go with the original plat or disagree over <br />the substantial change issue. A substantial change issue is somewhat gray in the fact a <br />change in name, I don't find that to be relevant at all as you view plats. The road issue is <br />somewhat vanilla itself, so that is kind of where we are at and he thinks that as a board <br />these are the only issues before them.
