December 2, 2008 <br /> The Mooresville Town Council met in regular session on Tuesday, December 2, 2008, at 6:30 P. <br /> M. at the Mooresville Government Center. <br /> Town Council members present were: President Mark Harris, Jeff Cook, John L. Clark, and <br /> Ryan Goodwin. Tony Langley was absent. Town attorney Tim Currens was present. <br /> Mary Ann Hawkin from St. Thomas Moore Church gave the prayer. <br /> A motion was made by Councilman Clark with a second by Councilman Cook to approve the <br /> minutes of the last meeting. Motion carried 4-0. <br /> Ross Holloway was on the agenda but rescheduled for the next meeting. <br /> Councilman Cook talked about adding additional holidays for employees. The list of added <br /> holidays would include: Martin Luther King Day, Presidents Day, Good Friday, Columbus Day, <br /> and Primary Election and General Election Day in years with state and municipal elections. <br /> Councilman Goodwin said four added in every calendar year and six on election years. <br /> Councilman Cook said he talked with Police Chief Viles and Fire Chief Farmer and both said it <br /> would not be any significant hours that would hurt them as far as shifts. A motion was made by <br /> Councilman Clark with a second by Councilman Cook to add the holidays. Motion carried 4-0. <br /> Next on the agenda, Doug Allen, Assistant Fire Chief, approached the council about the 1977 <br /> pension buyback for Police and Fire. At this time, Council President Mark Harris,removed <br /> himself from any comments or voting on this subject having been advised by legal counsel. Tom <br /> Parker from the 77 pension plan put figures together for a five year and ten year amortization. <br /> Doug Allen was requesting the council buy back time for thirteen employees. Buying back both <br /> the town portion and employee portion. There are six in the police department buying back <br /> thirty one years and seven in the fire department buying back 52 years at a total cost of <br /> $868,217.00. Councilman Goodwin commented this was an issue that had kept him up at night, <br /> because as an elected official and a police officer it was hard for him to separate in his mind. He <br /> said he had great respect for those on the list to be bought back but feels too conflicted and he <br /> excused himself from voting. He said he just did not feel comfortable voting on this issue. A <br /> motion was made by Councilman Cook with a second by Councilman Clark to approve the <br /> buyback. Since there were only four councilmen present and two not voting there was not <br /> enough for a quorum. Doug Allen told Councilman Goodwin town employees make decisions <br /> every day for the Town of Mooresville and he does not understand his excusing himself from <br /> voting. When the 77 Police and Fire Pension was instituted in Mooresville,the law stated age 35 <br /> and 20 years. Now the law has changed and police and fire can be bought back to date of hire. <br /> The civilian employees went into a Public Employee Retirement Fund and were bought back to <br /> date of hire. The law is different for civilian employees. Mr. Allen requested to be put on the <br /> December 16,2008 agenda. <br /> GG Foods was next on the agenda. This was tabled from the previous meeting. Council <br /> President Harris commented we had not rented to anyone for profit. It will cost extra monies for <br /> clean up, liability insurance, maintenance, etc. Council President Harris and Councilman <br /> Goodwin were not comfortable with the legal ramifications. Councilman Clark and Councilman <br /> Cook agreed with the liability issue. The consensus of the council was to not rent the building to <br /> GG Foods. <br /> A motion was made by Councilman Goodwin with a second by Councilman Clark to approve <br /> $1500.00 across the board for full time employees and 3% for part-time. Motion carried 4-0. <br /> Legal: Attorney Currens presented an amendment in a legal description for Ordinance 6, 2007 <br /> for•Meadowlake. That ordinance listed them to have 30 acres and they have 28.606 acres. A <br /> motion was made by Councilman Clark with a second by Councilman Goodwin to approve <br /> Ordinance 13, 2008. Motion carried 4-0. <br /> Fire Chief Les Farmer reported the new fire station should be closed up in two weeks. <br /> A motion was made by Councilman Clark with a second by Councilman Cook to approve <br /> transfer of funds in the amount of$190,000.00 from Wastewater Operating to Wastewater <br /> Improvement Fund. Motion carried 4-0. <br />
