3. That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use <br />of the property which would lend to multi-family dwellings <br />throughout the whole area which use would be too great of <br />impact on the surrounding traffic patterns and the <br />residential use provided an adequate buffer. <br /> <br />A motion was then made by Alan Kramer to approve the <br /> <br />respective variances and the findings of fact. This was seconded <br /> <br />by Vern Kimmel and passed by a vote of 4 in favor and 0 opposed. <br /> <br />The Board then proceeded to the findings under the special <br /> <br />exception procedure. After a discussion, the Board found <br /> <br />1. That the establishment, maintenance or operation of the <br />special exception of the planned unit development would not <br />be detrimental or endanger the public health, safety, morals <br />or general welfare since the uses were all compatible to the <br />area and proper access, water and sewer were being provided. <br />2. The special exception of the planned unit development <br />would not be injurious to the use and enjoyment of other <br />properties in the immediate vacinity for the purposes already <br />permitted since these uses were consistent with the area. <br />3. The establishment of the special exception as a planned <br />unit development would not impede or substantially alter the <br />normal or orderly development and improvement of the <br />surrounding property for uses permitted in the district and, <br />in fact, would help improve the development since sewers and <br />water lines were being extended to adjoining areas. <br />4. That adequate utilities, access roads, drainage and other <br />necessary facilities are being provided as shown by the <br />plat. <br />5. That adequate measures have been taken to provide ingress <br />and egress so designated as to minimize traffic congestion on <br />the public roads with an acceleration lane being provided. <br />6. That the special exception would be located in a district <br />where such use is permitted and all other requirements in <br />this ordinance are being met with the exception of the <br />variances which have been granted. <br /> <br />A motion was then made to approve the special exception <br /> <br />request and findings of fact by Alan Karmer. This was seconded by <br /> <br />Robert Tucker and passed unanimously. <br /> <br />-3- <br /> <br /> <br />
