Mr. Crouch asked if there was a valley there <br /> that flows to the east and Mr. Curry said the water come down the alley from High Street <br /> to South Street and at the corner of his property there is a drain that the town put in on the <br /> east side in the last six to nine months. And this has not helped. Mr. Crouch asked Mr. <br /> Holloway if he knew which way the water flowed and Mr. Holloway said the water <br /> flowed from the north to the south, except when if gets to the alley if flattens out and part <br /> of the problem is some of the building in the area are built low. Mr. Curry said his lot <br /> was the lowest on South Street. <br /> Mr. Holloway said to address Mr. Curry concerns, that when this gets to the Minor <br /> Platting that Mooresville does have an ordinance that they cannot increase the down <br /> stream discharge. They have enough area between the proposed house and the existing <br /> house to create a small retention area to contain the small water that they might creade by <br /> the construction of the proposed house. Granted that there is no place to take it to, but <br /> that is where the water goes now. They propose instead of trying to shed it off on Mr. <br /> Curry or even the neighbors to the north to retain the water on their site. To make this <br /> aesthetically pleasing and workable they might have to put in a stone bed, like a large dry <br /> well area. <br /> Mr. Crouch asked Mr. Holloway if he was familiar with the drain that Mr. Curry spoke of <br /> and he said he was. He said in photo number 5 you can see the drain. A few years ago <br /> the town had a project, in fact hired them to write some easements to construct a storm <br /> pipe from South Street down over the hill to the creek. He does not know how well these <br /> function, frankly by looking at the location it is high and Mr. Curry's dwelling is low, <br /> lower than the drain, so the drain does not do a whole lot of good. Mr. Crouch stated that <br /> the water for the proposed dry well had no place to go except underground. Mr. <br /> Holloway said that was what happens to everything up and down the alley and South <br /> Street, if it can't go down the pipe it goes underground. <br /> Mr. Curry asked if the town had put in a drain from South Street to the Shopping Center. <br /> Mr. Holloway said they have several years ago. Mr. Curry said it had not helped. Mr. <br /> Currens stated that that drain helped certain areas, but Mr. Curry's house was so low that <br /> it did not help him. <br /> Mr. Tom Moody, 126 W. South Street, said he went along with Mr. Curry, his lot and the <br /> lot next to his gets flooded when it rains. He stated that the drain did not do any good. <br /> He asked if they were proposing to build a double, and was told it will be a single-family <br /> dwelling. Mr. Currens said the property was not going to be rezoned; it will still be <br /> single family_ <br /> Under the Finding of Facts Mr. Barry said the water issue was still a problem to him. Mr. <br /> Swisher asked if the construction would increase the water problem. Mr. Barry said there <br /> was precedence for the problem in the area. Mr. Holloway said they would stipulate as <br /> part of the variance it be require that they not only provide for the drainage ordinances <br /> with drainage easement, but that they must construct some kind of retention system that <br /> will keep the extra water that they might generate from going on the adjacent lands. Mr. <br />
