MOORESVILLE BOARD OF ZONING APPEALS
MINUTES
THURSDAY, AUGUST 12, 2004
The Mooresville Board of Zoning Appeals met on Thursday, August 12, 2004 at 7:00 P.M. at the
Mooresville Town Hall.
Board members present were: Chairman., Alan Kramer, Christopher Crouch, Mike Young, Don
.Barry, and Jon Swisher. Town Attorney, Tim Currens, was also present.
A motion to approve the minutes of the July 8, 2004 meeting was made by Don Barry, second by
Christopher Crouch. Motion carried 5-0.
First on the agenda was Ross Holloway, Holloway Engineering, representing Mr. Ed Bartley
with a petition that was continued from the July 8, 2004 meeting. Mr. Holloway sent a letter
requesting a denial of the petition, because according to our Ordinance they need a waiver from
the Park Board to construct the advertising structure. The Park Board on July 12`h denied the
petition for a waiver unanimously.
Motion was made by Don Barry, second by Mike Young, to deny the petition by Mr. Ed Bartley
for a variance to construct the advertising structure on the northwest corner of the intersection of
State Road 144 and State Road 67. Motion carried 5-0.
Next was Ralph Foley, representing Cedar Run Limited, with a petition for a Special Exception
for a Church to be constructed in an area zoned B-2. Mr. Currens stated the Plan Commission
has already reviewed the Special Exception and have found that it does not adversely affect the
master land use plan and it is now ready to be heard this evening. Mr. Foley said that this parcel
is zoned B-2 for local business and our ordinance provided for a special exception for a church in
a B-2 district. This parcel is located at the corner of Heartland Boulevard and County Line
Road. Heritage Christian Church is seeking to expand their ministry and developed a new
church site where they can have enough parking and space for their building. There apparently
has been no interest in the site for local business and they have been unable to market it for retail
business. This would be a more compatible use for the neighborhood, fulfill the needs of the
church and the church would be able to expand their church building and be a good neighbor.
They stated that there was a mound around the parcel and they would not be taking the mounds
down. Mr. Jay Link of the Heritage Christian Church stated that their present building would
only hold around one hundred people comfortably, the building is not in real good shape and the
only parking is on the street. The new location would hold around six hundred people and they
would have ample parking space for them. They are excited about possibly being able to move
into the community of 2500 homes and being able to try and have a positive impact on the
community. Mr. Barry asked what their plans were for the existing church and Mr. Link stated
they were planning on selling to a smaller church. Mr. Swisher asked if there was an entrance
from Heartland Blvd. or was the only entrance from County Line Road? Mr. Foley said there
40 was an existing driveway that lines up with Ayrshire Circle. They are proposing a driveway
onto Heartland Blvd. and onto County Line Road.
i
