Mr. Kramer asked if there were any questions from the <br /> audience. There were no questions. <br /> After reading the fact-of-findings for a variance of use Mr. Kramer asked for a motion to <br /> approve or deny the petition. <br /> A motion to approve the variance of use for the Bed & Breakfast at 10302 N Pennington Road <br /> with the stipulation that all the standard requirements be met for setbacks and signs was made by <br /> Jon Swisher, seconded by Don Barry. Motion carried 4-0. <br /> Next was a petition for a variance of use to operate a Professional Counseling Office at 370 W <br /> Carlisle Street by Jerry &Judith Brown. They want to buy the house owned by Kim Napier at <br /> 3710 W Carlisle St.so they are requesting a variance of use. Judy wishes to operate a counseling <br /> business at that address. She has operated a counseling service on Main Street in Mooresville <br /> before, her office is currently in Plainfield, and now she would like to move back to Mooresville. <br /> Mr. Kramer said that Ms. Napier's name needed to be on the petition to be heard and Mr. Brown <br /> said that they had a letter stating that they had permission to apply for the variance and that she <br /> was present. He said the letter was in the file. Mr. Swisher asked if the driveway accommodated <br /> more that one vehicle. Mr. Brown said only one vehicle would fit in the driveway, but they were <br /> stating in the petition they would enlarge the driveway to accommodate two vehicles. He said <br /> the business normally only has one car at a time. Mr. Kramer said they would need a power of <br /> attorney to hear the petition and he did not see the power of attorney. Mrs. Brown stated that <br /> Ms. Napier was present and would they need anything from her. Mr. Kramer stated the problem <br /> was everything was spelled out the their name and her name was not on any of the paperwork. <br /> Since she owns the property her name should appear on the petition and in the publication. Mr. <br /> Kramer said they could not hear the petition unless her name was listed on the publication or <br /> they had a power of attorney. Mr. Kramer asked them to table the request until next month. Mr. <br /> Brown said they needed to close on the sale next week and if they could get the power of <br /> attorney would they still hear the petition tonight. Mr. Kramer said they could, but the power of <br /> attorney would have to have a date, state the subject matter, signed by both parties and notarized <br /> that they were not signing under duress. Mr. Kramer said they had about a half hour to get the <br /> power of attorney. <br /> Next was the Crossroads Apostolic Church, 220 Wheeler Street, requesting a variance for <br /> setbacks. Mr. Curtis White, Pastor, said over the last seven years they have seen a steady <br /> growth and they are in need of a larger education area. They have looked for land, available <br /> buildings they could renovate, and the things they have found are very expensive. The Church <br /> has not been able to finance a project of that size. For the last eleven months they have been <br /> looking at putting a modular building along side their existing building and the modular <br /> buildings they would use are identical to what the schools use for classrooms. They have found <br /> that this is the most cost efficient way to meet their needs. They have two lots and their existing <br /> building sets across the property lines of lot 54 and 45 in the Butler Addition. They will place <br /> 2 <br />
