Board of Zoning Appeals Minutes <br /> July 10, 2008. <br /> The Town of Mooresville Board of Zoning Appeals met on July 10, 2008 at the Mooresville <br /> Government Center at 6:00 p.m. Present were Chairman, Jon Swisher, Mike Young, Alan <br /> Kramer, Robert Williamson and Neal Allman. Absent was Town Attorney Tim Currens. <br /> Meeting was called to order by Jon Swisher. Motion was made by Alan Kramer, second by Mike <br /> Young to approve the minutes of June 12, 2008. Motion carried 5-0. <br /> On the agenda was Ross Holloway on behalf of Peak Outdoor Advertising, Inc. asking for <br /> approval for a tri-faced digital sign at the intersection of Hwy.144 and State Road 67 which was <br /> continued from the June 12, 2008 meeting. Mr. Holloway stated that Tony Langley of Orchard <br /> Country Store presented the Board with a letter stating"We respectfully withdrawal our <br /> complaint and opposition to further improvements or modifications to the stated billboard as <br /> discussed at the June 12, 2008 meeting." Mr. Monty Russell also withdrew any previous <br /> complaints. <br /> Peak Outdoor Advertising and their successors and assigns, voluntarily agree and commit to the <br /> following conditions: <br /> 1. The existing four faced sign previously approved will be modified to a tri-faced sign. <br /> 2. The north and south faces of the sign will be a digital, changeable, computer controlled <br /> message board. <br /> 3. The west sign face will be a"hi-vision/tri-panel"message board,not to exceed 300 square <br /> feet. <br /> 4. Each face of the advertising structure will not exceed the previously approved size of 360 <br /> square feet. <br /> 5. The maximum height of the sign structure will not increase from the previously approved <br /> size of 10 by 36 feet. <br /> 6. The maximum height of the sign structure will not increase from the previously approved <br /> height of 40 feet. <br /> 7. The previously approved setback of 20 feet will not change. <br /> 8. The previously approved sign edge setback of 4 feet will not change. <br /> 9. In lieu of the previously approved four faced, 60 square foot per face, sign that was <br /> dedicated to the Mooresville Parks Board and the Town of Mooresville for public service <br /> announcements, the Parks Board and/or Town of Mooresville will be provided 5% of the <br /> advertising time, in rotation with other advertisements, on each of the digital faces of the <br /> sign at no cost to the Board or Town, except for the cost of the production of artwork, unless <br /> the artwork is provided by the Board or Town. <br /> 10. No advertisement will be placed on any sign face that would be morally offensive to the <br /> community at large. <br /> The above requirements and conditions can not be changed without the approval of the Board of <br /> Zoning Appeals at a public hearing as provided in the Mooresville Zoning Ordinance. <br /> A motion to approve the request was made by Alan Kramer and second by Neal Allman. Motion <br /> carried 5-0. <br />
