MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br /> FOR VARIANCE FROM DEVELOPMENT STANDARDS <br /> Pursuant to TC 36-7-4-918 . 5, the Mooresville Board of Zoning <br /> Appeals having heard the Variance filed by Peak Outdoor <br /> Advertising, Inc. requesting. the following variance from <br /> development standards to allow the reconfiguration of an existing <br /> sign from a quad-faced to a tri-faced; to convert two faces to a <br /> digital, changeable, computer controlled message board and the <br /> third face to a tri-face using louvers; to allot the elimination <br /> of the sixty square foot public announcement sign so that five <br /> percent of the digital billboard time would be devoted to the <br /> Town of Mooresville for public announcements, the setback, <br /> height, location and size of the faces would not change, now <br /> makes the following Finding of Fact pursuant to IC 36-7-4--918 . 5: <br /> 1 . The approval will not be injurious to the public <br /> health, safety, morals, and general welfare of the community for <br /> the following reasons: the sign will be located in a commercial <br /> zoned area and limits the type of advertising <br /> 2 . The use and value of the area adjacent to the property <br /> included in the variance will not be affected in a substantially <br /> adverse manner due to the following: advertising structures are <br /> allowed in this district and location maximizes its distance to <br /> adjacent properties <br /> 3 . The strict application of the terms of the Zoning <br /> Ordinance will result in practical difficulties in the use of the <br /> property. However, the Zoning Ordinance may establish a more <br /> strict standard that the "practical difficulties" standard <br /> prescribed by this subdivision. The actual practical difficulties. <br /> found to exist here are as follows : this area has substantial <br /> fill and is not suitable for other productive uses <br /> Stipulations to run with the Variance: <br /> See attached <br />
