O TOWN OF MOORESVILLE <br /> BOARD OF ZONING APPEALS <br /> THURSDAY, FEBRUARY 9, 2012, 6:00 P. M. <br /> The Board of Zoning Appeals met on Thursday, February 9, 2012 at 6:00 P. M. at the <br /> Mooresville Government Center. <br /> Members present were: Chairman Neil Allman, Mike Young, and Ann Whaley. Alan <br /> Kramer was absent. Town attorney Tim Currens was present. <br /> A motion was made by Ann Whaley with a second by Mike Young to approve the <br /> minutes as submitted of the January 12, 2012 meeting. Motion carried 3-0. <br /> Jim Smillie, Golars LLC, appeared before the board to request a variance from <br /> development standards, a variance for placement of a remediation system. The gas <br /> station at the corner of South Indiana Street and West Harrison Street had a gasoline <br /> release years ago and IDEM has asked for this project to be completed. Golars needs to <br /> put a trailer with pumping equipment to use on three wells on the property and they may <br /> be there for 3-5 years. The 24 ft. by 8 ft. trailer will have to go at the back of the gas <br /> station and that will be a tight fit but is the only place they can put the trailer. The trailer <br /> is 10 ft. high and will be a foot from the back property line and a foot from the side <br /> • property line. <br /> Ann Whaley asked if the trailer would obstruct any traffic view. The trailer will not stick <br /> out but will be seen from West Harrison Street. The pump and treat will clean up <br /> contamination. There are a series of tanks to separate the water and vapor and add <br /> carbons and then the treated water goes into the sewer system. The vapor from the <br /> gasoline goes into the air. Attorney Currens informed the board that Town Council <br /> signed a release for monitoring and paying for the treated water that goes into the sewer <br /> system. <br /> The monitoring wells were put in years ago. A neighbor asked about the noise level and <br /> the gas vapor in the air. Mr. Smillie said the noise would be no louder than an air <br /> conditioner or the refrigeration units already there and the vapor in the air would be no <br /> more than is already put out by the gas station. <br /> A motion was made by Ann Whaley to grant the variance from developmental standards <br /> with the setbacks on the back from 12 foot to 1 foot and from 6 foot to one foot on the <br /> sides,the structure to be removed after completion. Mike Young added a stipulation the <br /> noise ordinance is obeyed. Ann agreed and added that with her motion. Motion carried <br /> 3-0. <br /> Verizon Wireless will be back to the BZA in March. Nicepak set their infirmary trailer <br /> back more than zoning standards so they did not need to come back to the BZA. They <br /> already have their permit. <br />
