S <br /> MOORESVILLE PLAN COMMISSION <br /> MINUTES <br /> NOVEMBER 12, 2009 <br /> The Mooresville Plan Commission met in regular session on Thursday November 12,2009 at the <br /> Mooresville Government Center.The meeting followed the Board of Zoning appeals. <br /> Members present were Chairman Mike Young,Ann Whaley,Perry King,Charles Berwick,Jeff Dieterlen <br /> and Darrell Brown.Town attorney Tim Currens was also present.Brian Anderson was absent {on duty) <br /> The meeting was called to order by Chairman Young,at this time he asked for corrections or question on <br /> the minutes from the October meeting. Commissioner Brown motioned to accept the minutes as written, <br /> with the second coming from Commissioner Berwick,the motion carried 6-0 with none opposed. <br /> Ross Holloway returned with Charlie Henard on the(2 lot Minor Plat)Allison and St Rd 67.Mr.Holloway <br /> said that since the last meeting he had with INDOT also had an e-mail from Mr.Jester from the Greenfield <br /> Dist.Permit division say that the state owns quite away and the recommendation still stands it has to be <br /> separate properties.Mr.Jester met them out there to see the area;he wanted to check how far their right of <br /> way went.It is as they(Holloway)has shown and the response from INDOT is it has to be separate <br /> parcels.The concerns about the parking were addressed.Mr.Holloway had a plan with Mooresville's 9x20 <br /> ft.parking spaces on proposed lot 1 laid out for good access for a possible 84 parking spaced,also a <br /> possible 9 spaces on proposed lot 2,that would be subject to a cross parking easement.They have put a <br /> decoration that effect as item number 4 on the dedication of the plat.With this there are a total of 93 <br /> reasonable and possible on the property.Mr.Holloway feels that if the spaces were striped,the south east <br /> part would need a hard surface as well as the area east that is grass.When they met with Mr.Jester there <br /> was no guarantee that a drive could be built without acquisition of addition right of way. Commissioners <br /> Dieterlen ask for clarification about it need to be two separate properties for the state to entrain a drive <br /> application. Mr.Holloway said that yes this was correct.Commissioner Brown asked if this was allowed <br /> and the drive was not allowed,would this need to come back to be redone.Chairman Young said that it <br /> could be contingent on getting the permit for a drive.Mr.Henard said that the plat was approved with the <br /> easement he would not need another drive.With more discussion on parking,access and Commissioner <br /> Brown expressing his concern on access for fire trucks etc.Mr. Currens said that the job of the <br /> Commissions job is to decide if the requirements are met for a minor plat.Commissioner Whaley expressed <br /> more concerns on parking,striping and signs for towing if not parked correctly. Chairman Young asked for <br /> a motion.A motion was made to approve this minor plat with the contingency that access is granted and <br /> that parking being made by Commissioner Berwick seconded By Commissioner Dieterlen the vote was 4-2 <br /> with Commissioners Brown and King voting no.This Minor Plat will return Dec. 10 meeting. <br /> Ross Holloway came for Rick Deckard asking for a rezone for the property at 12150 N.Rooker Road for a <br /> PUD Residential.Mr.Holloway said that they know that they do not have everything that is required at this <br /> time because late filing after deciding on the PUD R.This request is for a Senior Community,the tenets are <br /> to be 55 and over,a second occupant can be under 55 if they are a spouse or close family member.There <br /> will be 28 1 bedroom apartments;people with disabilities governed by the fair housing act age would not <br /> apply although the age would not apply for a care giver. There were several other rules such as keeping <br /> premises neat and well kept.The proposal is to reuse the resisting building as well as 4 new 4 plex units, <br /> Which would be 44 residential units on 5.1 acres?The plan has 77 parking spaces that would be close to 2 <br /> spaces per unit.They have reduced the impervious area from 69,000 Square feet to 50,000 square feet <br /> which reduces run off.Mr.Deckard has had experience in redoing old buildings;Mr.Holloway said that <br /> every thing would be brought to current code.Mr.Deckard showed pictures of an old school that he had <br /> redone,he also showed a land scope plan. The building will have a hunter green roof,porches, laundry <br /> hook ups in most apartments as well a laundry room.The apartments range from 750 square feet to 860 <br /> square feet,there also will be a community room.Rent ranging from$575 to$650.There will be a full time <br /> manager.Mr.Deckard did mention that Mr. and Mrs.Jim Wheeler had a few concerns mostly being <br />
