Board of Zoning Appeals Minutes <br /> Thursday September 12'h, 2013 <br /> Members present: Mike Young, Perry King, Neal Allman, Alan Kramer and town <br /> attorney Tim Currens. <br /> Mark Peden presented a variance request at 307 E. St Rd 42 on behalf of Edward <br /> and Bonnie Hall. The variance request is to allow a residence on less than 2 acres <br /> as well as permit two homes on one septic. Mr. Peden introduced the property <br /> owners, property purchasers and the contractors prepared to build the home <br /> provided the request for variance is passed. Mr. Peden explained a previous <br /> eminent domain removed a house and section .283 acres of land from this location. <br /> The owners are now in the process of selling the property, the buyers wish to build <br /> a house on the remaining 1.048 acres and connect to the septic. Mr. Peden <br /> explained that as the size of the lot is a state provided hardship, granting the <br /> variance for residential use on the smaller lot would be the best use. Mike Young <br /> asked, Tim Currens clarified that the family was financially compensated for the <br /> loss of land and home, however the hardship is now that the remaning lot is not <br /> size required to build the home at that location. Neal Allman asked about out <br /> buildings and or garages, there is a garage that will remain for storage a 2 car <br /> garage will be built attached to the home. Alan Kramer questioned the property <br /> lines and where the driveway would be, the contractors indicated that the drive <br /> would come off Cooney Rd due to elevation and that there was adequate footage. <br /> Alan Kramer also questioned the septic system, Tim Currens that as long as their <br /> plans meet the board of health standards that is not for the commission to decide. <br /> Neal Allman called for any other questions, none were asked, Neal Allman read <br /> the ordinance / fact of findings, Alan Kramer made a motion to pass with the <br /> expectation that all building permits, septic permits and driveway permits are <br /> obtained. Mike Young seconded this motion and the motion passed. Neal Allman <br /> called for any new business, Tim Currens presented the commission with multiple <br /> facts of findings for final signatures, the commission passed a motion to sign all of <br /> them as typed. Perry King made a motion to adjourn the meeting, it was seconded <br /> and the meeting was adjourned. <br />
