FINDINGS OF FACT

Re: Roger Caperton, Steven Buchanan, Donald Stafford
Roberson Woods Subdivision

This matter came before the Mooresville Board of Zoning
Appeals on April 18, 1990, at the regularly scheduled meeting
date and time. The petition requested a variance from the
development standards of the Subdivision Control Ordinance
of 2 1/2 to 1 on lots 10, 1~, 24, 25, and 39 at Roberson Woods
Subdivision located on Highway 67 and Bridge Street.

The Mooresville Board of Zoning Appeals having heard
evidence on the above captioned petition now makes the following
findings of fact pursuant to I. C. 36-7-4-918.5:

1. That the request would not be injurious to the public
health, safety, morals and general welfare of the community

in that the purpose of
increase in the normal
injury to the public.

the retention pond was to prevent an
flow rate and would in fact prevent

2. The Indiana Department of Environmental Management
restrictions for the necessity of a retention pond will actually
prevent the use and value of the area adjacent to the property
included in the variance from being affected in a substantially
adverse manner.

3. The strict application of the terms of the zoning
ordinance would result in practical difficulties in the use
of the property in that the deviations from the normal width
to length ratio in the ordinance are necessary to allow for
