FINDINGS OF FACT <br /> <br />Re: Roger Caperton, Steven Buchanan, Donald Stafford <br /> Roberson Woods Subdivision <br /> <br /> This matter came before the Mooresville Board of Zoning <br />Appeals on April 18, 1990, at the regularly scheduled meeting <br />date and time. The petition requested a variance from the <br />development standards of the Subdivision Control Ordinance <br />of 2 1/2 to 1 on lots 10, 1~, 24, 25, and 39 at Roberson Woods <br />Subdivision located on Highway 67 and Bridge Street. <br /> <br /> The Mooresville Board of Zoning Appeals having heard <br />evidence on the above captioned petition now makes the following <br />findings of fact pursuant to I. C. 36-7-4-918.5: <br /> <br /> 1. That the request would not be injurious to the public <br />health, safety, morals and general welfare of the community <br /> <br />in that the purpose of <br />increase in the normal <br />injury to the public. <br /> <br />the retention pond was to prevent an <br />flow rate and would in fact prevent <br /> <br /> 2. The Indiana Department of Environmental Management <br />restrictions for the necessity of a retention pond will actually <br />prevent the use and value of the area adjacent to the property <br />included in the variance from being affected in a substantially <br />adverse manner. <br /> <br /> 3. The strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use <br />of the property in that the deviations from the normal width <br />to length ratio in the ordinance are necessary to allow for <br /> <br /> <br />
