MINUTES OF THE BOARD OF ZONING APPEALS

The Mooresville Board of Zoning Appeals met on Wednesday,
March 21, 1990, at 7:00 p.m. Present were Board Members Donald
Barry, Vernon Kimmel, Robert Tucker, and Alan Kramer. Chairman
Barry determined there was a quorum present and proceeded to
approval of the minutes and findings of fact of the February
meeting. The first item on the agenda was the request of First
National Bank for a variance from set-back line requirements and
the ],000 foot interval requirements for business sign or
advertising structures. In particular the set-back variance was
from 60 feet to 30 feet. Present for First National Bank was Mark
Peden and bank employee Stan Miller. Mr. Peden stated the purpose
of the variance at Moore Street and Indiana Street and showed a
diagram of the intersection which marked the location of the sign.
He advised that one-half of the sign would be dedicated to Ward's
Apparel with a small portion to Pizza Hut and the balance to First
National Bank. A diagram of the sign was introduced as an exhibit
showing a sign 28 feet in height with the bottom sign being 17
feet off of the ground. The sign would have signage for Pizza
Hut, First National Bank, and Ward's Apparel. The sign would have
internal lighting. Bob Tucker raised the issue of the traffic
light and visibility. After review of the intersection and the
sign, the Board found that the sign was back far enough as to not
create any problem. Mr. Tucker also had a problem concerning
restrictions to keep any additional signs below the 17 foot level,
finding that this could create a problem for traffic. Alan Kramer
had a question concerning the location of the sign in regard to
