FINDINGS OF FACT <br /> <br />RE: Faye Goldman <br /> 22 North Clay Street <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br /> <br />October 18, 1989, at the Mooresville Town Hall, The petition requested a <br />variance to conduct a craft store which would fall under a local business <br />classification. <br /> <br />The Board of Zoning Appeals having heard evidence on the above captioned <br />petition, now makes the following findings of fact pursuant to I.C. 36-7-4-918.4: <br /> <br /> 1. That the approval of this variance would not be injurious to the <br /> <br />public health, safety, morals, and general welfare of the community since it <br /> <br />was compatible with the area and past uses. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br /> <br />in the variance would not be affected in a substantially adverse manner since <br />the property had been used for other business uses and the residential rental <br />use had had more of an adverse affect. <br /> <br /> 3. That the need for the variance arises from conditions peculiar to this <br />property in that the size of the lot, location on the alley, and original <br />construction as a business use limit the current use of the property. <br /> <br /> 4. That the strict application of the terms of the zoning ordinance would <br />constitute unnecessary hardship if applied to this property due to the limited <br />use acceptable for residential purposes. <br /> <br /> 5. That the approval does not interfere substantially with the comprehensive <br />plan due to other businesses in the area and the location on the alley. <br /> <br />Chairman <br /> <br />Secretary <br /> <br /> <br />
