MINUTES OF THE MOORESVILLE <br /> BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its regularly scheduled <br />meeting on Wednesday, September 20, 1989 at 7:00 p.m. Present were board <br />members Robert Tucker, Don Barry, Vern Kimmel, and Alan Kramer. Chairman <br />Tucker determined a quorum was present and proceeded with approval of the <br />minutes of the prior meeting. <br /> <br /> The first item to come before the board was the variance request of <br /> <br />Mark B. and Darla J. Robinson. The board found that notices were in order <br />and proceeded with the presentation of the variance by the Robinson's. Mr. <br />Robinson advised that they were seeking a variance from the Subdivision <br />Control Ordinance in order to build on 3.583 acres which was being set apart <br />from their father's farm. The property in question was approximately 2200 <br />feet off the road and water and electric easements would be obtained through <br />Don Adams' property. The sketch of the area was shown. Alan Kra.:~er questioned <br />the petitioners concerning the l~cation of the drive and the same was shown <br />to him. Chairman Tucker asked if there were questions from the floor, <br />there being none the board proceeded to its discussion of the variance from <br />the development standards. The board reviewed the Subdivision Control <br />Ordinance and then made its findings concerning this variance from the <br />development standards. The board discussed whether or not the approval <br />would be injurious to the public health, safety, morals and general welfare <br />of the community. <br /> <br /> 1. Don Barry advised that he found no problems with this as did Vern <br />Kimmel and Alan Kramer, in particular, finding that due to the size of the <br />lot in question, the utility easement being run and proper access. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br />in the variance would not be affected in a substantially adverse manner. The <br /> <br /> <br />
