MINUTES OF THE MOORESVILLE <br />BOARD OF ZONIING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met at its regularly <br />scheduled meeting place, the Mooresville Town Hall, on Wednesday, <br />May 17, 1989, at 7:00 P.M. Present were Board members Robert <br />Tucker, Don Barry, Vernon Kimmel, Steve Oschman, and Alan Kramer. <br />The Board's Attorney, Timothy C. Currens, was also present. The <br />Board proceeded to approve the Minutes and Findings of Fact of the <br />prior meeting. Attorney Currens then advised the Board of the <br />Plan Commission's report on the special exception petition of <br />Marlena Newcomb concerning the property at 117 E. South Street. <br />The Plan Commission advised the Board that they felt the special <br />exception was not compatible with the Master Land Use Plan in that <br />it would be a form of spot zoning by placing a business use in the <br />middle of residential uses. A few of the remonstrators from the <br />past meeting were present for this case but the Board's attorney <br />advised that no legal notices had gone out and for this reason <br />there would be no public hearing until the proper legal notices <br />were filed. <br /> <br /> The Board then discussed the new filing of Charles A. and <br /> Elaine T. O'Neal at 267 E. Main Street. The Board's Attorney <br /> advised that this matter had been filed recently and possibly <br /> notices had not gone out yet but each of them should at least look <br /> at it prior to the next meeting. <br /> <br /> Kaye Don Haught, the Brown Township Trustee, was present and <br /> had a question regarding use of a single family dwelling for <br /> <br /> <br />
