FINDINGS OF FACT <br /> <br />RE: <br /> <br />Thurmon Jacobs <br />1965 and 1963 Allison Road <br /> <br /> This matter came before the Mooresville Board of Zoning <br />Appeals on April 20, 1989, at 7:30 P.M. at Mooresville Town Hall. <br />The petition requested a variance from the subdivision control <br />ordinance in order to sell off 1.12 acres with a house on it, with <br />the intent to build an additional house on the remaining 3.04 <br />acres, and with one property being sold with improvements having <br />170 feet of road frontage and and the other property having 145 <br />feet of road frontage. <br /> <br /> The Board of Zoning Appeals having heard evidence on the <br />above captioned petition, now makes the following findings of fact <br />pursuant to I.C. 36-7-4-918.5: <br /> <br /> 1. That the approval of this variance from the development <br />standards would not be injurious to the public health, safety, <br />morals, and general welfare of the community due to the size of <br />the lots and the location of this ground. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance would not be affected in any <br />substantially adverse manner due to the way the ground was <br />located, the area it is located in, and the size of the lots. <br /> <br /> 3. That the strict application of the terms of the zoning <br /> ordinance would result in practical difficulties in the use of the <br /> property due to the amount of ground involved and the location of <br /> the ground being adjacent to Allison Road and not necessitating <br /> <br /> <br />
