FINDINGS OF FACT

RE: Michael R. King and
Deborah D. King
540 Keller Hill Road

This matter came before the Mooresville Board of Zoning
Appeals on March 15, 1989, at 7:30 P.M. at Mooresville Town
Hail. The petition requested a variance from the subdivision
control ordinance to allow for the subdividing of a 6.032
acre tract of land into two equal parcels of 3.016 acres each.

The Board of Zoning Appeals having heard evidence on the
above captioned petition, now makes the following findings
of fact pursuant to I.C. 36-7-4-918.5:

3. Approval would not be injurious to the public health,
saftey, morals and general welfare of the community since the area
was presently being developed for residential use and the proposal
only increased the density of that use in that the applicants were
desiring to place two residential homes on three acre lots instead
of one residential home on a six acre lot. Further, with regard
to the depth to width ratio the land in question is of sufficient
size so as not to create a health or safety problem.

2. The use and value of the area adjacent to the property
included in the variance would not be affected in a substantially
adverse manner since developing the tracts with residential homes
would increase the value of other homes adjacent to the
petitioners' property. Further, with regards to the depth to
width ratio the land will be of similar size to other parcels of

land in the immediate area.
