FINDINGS OF FACT

RE: Thurmon Jacobs
1965 and 1963 Allison Road

This matter came before the Mooresville Board of Zoning
Appeals on April 20, 1989, at 7:30 P.M. at the Mooresville Town
Hall. The petition requested a variance from the development
standards for minimum lot width.

The Board of Zoning Appeals having heard evidence on the
above captioned petition, now makes the following findings of fact
pursuant to I.C. 36-7-4-918.5:

1. The approval of this variance from the development
standards would not be injurious to the public health, safety,
morals, and general welfare of the community due to the size of
the lots and the location of this ground.

2. That the use and value of the area adjacent to the
property included in the variance would not be affected in any
substantially adverse manner due to the way the ground is located,
the area it is located in, and the size of the lots.

3. That the strict application of the terms of the zoning
ordinance would result in practical difficulties in the use of the
property due to the shape of the respective parcels.

ATTEST:

~e~retary

Chairman

Dated: May 17, 1989
