Re: <br /> <br /> FINDINGS OF FACT <br /> <br />Joe Thompson <br />54 Crestwood Drive <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals <br /> <br />on January 20, 1988, at the regularly scheduled meeting date and <br />time. The petition requested a variance from the development standards <br />as to rear and side set-backs. <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br /> <br />on the above captioned petition now makes the following findings <br /> <br />of fact pursuant to I.C. 36-7-4-9-18.5: <br /> <br /> (7) The Board found that the approval would not be injurious <br /> <br /> to the public health, safety, morals and general welfare of the <br /> community and in fact should assist the well being of the area by <br /> helping the traffic flow. <br /> <br /> (2) That the use and value of the area adjacent to the <br /> <br /> property included in the variance would not be affected in a <br /> substantially adverse manner in that this use was consistent with <br /> other structures in the area and should only improve values. <br /> <br /> (3) That the strict application of the terms of the zoning <br /> ordinance would result in practical difficulties in the use of the <br /> property in that additional structures that would help property <br /> values could not be placed without such a variance. <br /> <br /> /~C hma~n~ Ch~a i r m~a n <br /> <br /> Warren Franklin, Secretary <br /> <br />Dated: February /~ , 1988 <br /> <br /> <br />
