MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS

The Mooresville Board of Zoning Appeals met at its regular
meeting place at the Mooresville Town Hall the 17th day of
February, 1988. Present were board members Steve Oschman,
Tilford Bailey, Warren Franklin, Don Barry, and Robert Tucker.
The first item on the agenda was the approval of the minutes and
finding of facts of the prior meeting. After Chairman Oschman
determined that there was a quorum present he proceeded with the

approval of the minute~ and findings of
approved by the members present at that

The first item on the agenda was the
Redman of 16 Keller Drive, Mooresville,

fact which were unanimously
time.
variance request of Phillip
Indiana requesting a variance

from the development standards on the back yard set-back from
forty (40) feet to fourteen (14) feet to place a garage. Ron Elkins
was present on behalf of Mr. Redman and explained the variance
and the hardship due to the slope of the land and the location of
the septic/finger system. The Board had a discussion of the
proposed variance and asked for responses from the floor. The

only remonstrator present was Herb Hoffman of 28 Keller Drive

who stated that he was the next door neighbor and was in favor
of the request as stated. The Board proceeded to findings of fact
as follows:

1. That the approval would not be injurious to the public
health, saftey, morals and general welfare of the community due to
the size of the lot and the development in the area.

2. That the use and value of the area adjacent to the property
included in the variance would not be affected in a substantially
adverse manner due to the size of the lot and the development of
the subdivision in general.
