FINDINGS OF FACT <br /> <br /> Re: Raesta Estates, Inc. <br /> 365 West Carlisle Street <br /> <br /> This matter came before the Mooresville Board of Zoning <br />Appeals on March 16, 1988, at the regularly scheduled meeting <br />date and time. The petition requested a variance from the <br />development standards as to set-back lines. <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br />on the above captioned petition now makes the following findings <br />of fact pursuant to I. C. 36-7-4-9-18.5: <br /> <br /> 1. That the approval would not be injurious to the public <br />health, safety, morals and general welfare of the community since <br />the set-backs proposed would not interfere with any of the other <br /> <br /> that area and would be basically consistent with the <br /> <br />uses in <br /> <br />area. <br /> <br /> 2. That the <br />property included <br /> <br />use and value of the area adjacent to the <br />in the variance would not be affected in a <br />substantially adverse manner due to the way the structure would be <br />located and due to the angle of the streets in the area. <br /> <br /> 3. That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the use of the <br />property which would restrict the type of building that could be <br />placed on said property and due to the shape of the property all <br />of which would result in a structure which might hurt the <br /> <br />adjoining property values <br /> <br />if strictly enforced. <br /> <br /> ~teve Oschman, Chairman <br /> <br />Dated: <br /> <br /> <br />
