Re: <br /> <br /> FINDINGS OF FACT <br /> <br />Gordon and Linda Esterline <br />Corner of Indiana and County Line Road <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals <br />on June 15, 1988, at the regularly scheduled meeting date and time. <br />The petition requested a variance from the development standards <br />on the rear set-back from forty (40) feet to twenty and one half <br />(20-1/2) feet. <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br />on the above captioned petition now makes the following findings <br />of fact pursuant to I.C. 36-7-4-9-18.5: <br /> <br /> (1) The Board found that the approval would not be injurious <br />to the public health, safety, morals and general welfare of the <br />community due to the location of the house and the size and <br />location of the house on the lot. <br /> <br /> (2) That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner in that the construction should <br />improve property values in this area. <br /> <br /> (3) That the strict application of the terms of the zoning <br />ordinance would result in practical difficulties in the <br />development of this property due to the fact that it would be <br />difficult to construct a~y reasonable home on the lot that would <br /> <br />meet all set-back requirements. <br /> <br />V~ar~en Fr~h~k~itin,~ ~ecretary <br /> <br />StEve Oschman, Chairman <br /> <br />Dated: July 20, 1988 <br /> <br /> <br />
