FINDINGS OF FACT

RE:

Dr. Arcadio and Mrs. Remedios Alarcon
432 North Monroe Street
Mooresville, Indiana

This matter came before the Mooresville Board of Zoning
Appeals on December 16, 1987, at the regularly scheduled
meeting date and time. The petition requested a variance
to allow a residential use on the one story dwelling located
on the property which is currently zoned Local Business.

The Mooresville Board of Zoning Appeals having heard evidence
on the above captioned petition now makes the following findings
of fact pursuant to I.C. 36-7-4-19.4:

]. That the approval would not be injurious to the public
health, safety, morals and general welfare of the community
due to the nature of the proposed Residential Use.

2. That the use and value of the area adjacent to the
property included in the variance would not be affected in a
substantially adverse manner if the variance was granted in
that there are other residential uses in the area.

3. That the variance did not arise from any condition
peculiar to the property involved and that the property could
be used for local business uses.

4. That the strict application ofthe terms of the zoning

ordinance did not

if applied to the

in fact, that the

from the Residential Use to the Business

constitute any type of unnecessary hardship
propety for which the variance is sought and,
petitioner naO requested the rezoning change

Use which created the

hardship complained of.
