FINDINGS OF FACT <br /> <br />RE: <br /> <br />Dr. Arcadio and Mrs. Remedios Alarcon <br />432 North Monroe Street <br />Mooresville, Indiana <br /> <br /> This matter came before the Mooresville Board of Zoning <br />Appeals on December 16, 1987, at the regularly scheduled <br />meeting date and time. The petition requested a variance <br />to allow a residential use on the one story dwelling located <br />on the property which is currently zoned Local Business. <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br />on the above captioned petition now makes the following findings <br />of fact pursuant to I.C. 36-7-4-19.4: <br /> <br /> ]. That the approval would not be injurious to the public <br />health, safety, morals and general welfare of the community <br />due to the nature of the proposed Residential Use. <br /> <br /> 2. That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner if the variance was granted in <br />that there are other residential uses in the area. <br /> <br /> 3. That the variance did not arise from any condition <br />peculiar to the property involved and that the property could <br />be used for local business uses. <br /> <br /> 4. That the strict application ofthe terms of the zoning <br /> <br />ordinance did not <br /> <br />if applied to the <br /> <br />in fact, that the <br /> <br />from the Residential Use to the Business <br /> <br />constitute any type of unnecessary hardship <br />propety for which the variance is sought and, <br />petitioner naO requested the rezoning change <br /> <br /> Use which created the <br /> <br />hardship complained of. <br /> <br /> <br />
