FINDINGS OF FACT <br /> <br /> RE: William R. and Joan Fuller <br /> 927 South Johnson Road <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals <br />on November 18, 1987, at the regularly scheduled meeting date and <br />time. The petition requested a variance to operate a catering <br />business from their home. <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br />on the above captioned petition now makes the following findings <br />of fact pursuant to I.C. 36--7-49-18.5: <br /> <br /> (1) That the approval would not be injurious to the public <br />health, safety, morals or general welfare of the community due to <br />the nature of the proposed business usage. <br /> <br /> (2) That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner since there was no sign nor outward <br />sign of the business usage other than the van. <br /> <br /> (3) The board could not find that the variance arose from <br />any condition peculiar to the property. <br /> <br /> (4) The board found that the strict application of the terms <br />of <br /> <br /> if <br /> <br /> (5) That the approval <br />the comprehensive plan. <br /> <br />the zoning ordinance would not constitute an unnecessary hardship <br />applied to the property for which the variance was sought. <br /> <br /> does not interfere substantially with <br /> <br />Warren-FraEklin-, Secretary <br />Dated: /~'/~ /,/'//~ <br /> <br />~i~ord Ba'i~y, iJice-Chairman <br /> <br /> <br />
