FINDINGS OF FACT

RE: William R. and Joan Fuller
927 South Johnson Road

This matter came before the Mooresville Board of Zoning Appeals
on November 18, 1987, at the regularly scheduled meeting date and
time. The petition requested a variance to operate a catering
business from their home.

The Mooresville Board of Zoning Appeals having heard evidence
on the above captioned petition now makes the following findings
of fact pursuant to I.C. 36--7-49-18.5:

(1) That the approval would not be injurious to the public
health, safety, morals or general welfare of the community due to
the nature of the proposed business usage.

(2) That the use and value of the area adjacent to the
property included in the variance would not be affected in a
substantially adverse manner since there was no sign nor outward
sign of the business usage other than the van.

(3) The board could not find that the variance arose from
any condition peculiar to the property.

(4) The board found that the strict application of the terms
of

if

(5) That the approval
the comprehensive plan.

the zoning ordinance would not constitute an unnecessary hardship
applied to the property for which the variance was sought.

does not interfere substantially with

Warren-FraEklin-, Secretary
Dated: /~'/~ /,/'//~

~i~ord Ba'i~y, iJice-Chairman
