2. That the use and value of the area adjacent to the property <br />included in the variance would not be affected in a substantially <br />adverse manner for the reason that a majority of the homes in the <br />area have garages constructed approximately five feet off the property <br />line and this would be consistent with the majority of the neighborood. <br /> <br /> 3. The board found that the strict application of the terms of <br /> <br />the zoning ordinance would result in practical difficulties in the <br />use of the property in that the lots in this neighborhood are not <br />big enough to support an accessory building within the given set-backs. <br /> <br /> Based upon the requirements having been met Tilford Bailey moved <br /> <br />to grant the variance. The motion was seconded by Warren Franklin <br /> <br />and unanimously carried. <br /> <br /> The final petition for the evening was the petition of Dr. <br /> <br />Arcadio Alarcon for a variance to allow for a one family residential <br />use on a parcel of land zoned local business. Dr. Alarcon indicated <br />that the property was not suited for business because of the unusual <br />depth of the land being two hundred fifty-seven feet. He advised <br />that in his opinion no one would want to use it for business. He <br />said the entire tract of land contains of three and one half acres. <br />He said the home in question was originally set up as a residence <br />and has in fact been used as such for thirty or more years. He advised <br />that if the property is not allowed to be used for a residence it <br />will remain empty and will give rise to vandalism. <br /> <br /> Dr. Alarcon did advise that the home was used by him as an office <br />when he first purchased the property. He indicated that he had the <br />property rezoned when he first purchased it from A-residential to <br />local business. The board indicated that they felt the appropriate <br />petition should be a special exception and not a variance and suggested <br /> <br /> --4-- <br /> <br /> <br />
