FINDINGS OF FACT <br /> <br /> RE: Delmos and Mary Bishop <br /> 1068 Delwood Drive <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals <br /> <br />on October 21, 1987, at the regularly scheduled meeting date and <br />time. The petition requested a variance from the development <br />standards to allow the construction of a garage on their property. <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br /> <br />on the above captioned petition now makes the following findings <br /> <br />of fact pursuant to I.C. 36-7-4-9-18.5: <br /> <br /> 1. That the approval would not be injurious to the public <br /> <br />health, safety, morals and general welfare of the community and <br />that this is a residential area and the construction of a garage <br />is an accessoryuse in said areas. <br /> <br /> 2. That the use and value of the area adjacent to the property <br />included in the variance would not be affected in a substantially <br />adverse manner for the reason that a majority of the homes in the <br />area have garages constructed approximately five feet off the property <br /> <br /> consistent with the majority of the <br /> <br />line and this would be <br />neighborhood. <br /> <br /> 3. That the strict <br />ordinance would result <br /> <br />application of the terms of the zoning <br />in practical difficulties int he use of the <br />property in that the lots in this neighborhood are not big enough <br />to support an accessory building within the given set-backs. <br /> <br />Ti~ord 'Ba i 1 e~, <br /> <br />Chairman <br /> <br />Dated: November 18, 1987 <br /> <br /> <br />
