FINDINGS OF FACT

RE: William E. Hardcastle
2, 4, 6 & 8 Williams Drive

This matter came before the Mooresville Board of Zoning Appeals
on September 16, 1987, at the regularly scheduled meeting date and
time. The petition requested a variance from the development
standards of the ordinance to reduce the set-back requirements
from twenty (20) feet to ten (10) feet.

The Mooresville Board of Zoning Appeals having heard evidence
on the above captioned petition now makes the following findings
of fact pursuant to I.C. 36-7-4-19.4:

1. That the approval would not be injurious to the public
health, safety, morals or general welfare of the community and
that the area in question is presently zoned for multi-family
use and the construction of a garage is an accessory use allowable
on the property and the reduction from the set-back requirements of
twenty (20) feet to ten (10) feet would not have any adverse
impact upon the public.

2. That the use and value of the area adjacent to the property
included in the variance will not be affected in a substantially

adverse manner for the same reason that
garage is all~ed as an accessory use on
multi-family dwelling.

the construction of a
property zoned for

3. That the strict application of the terms of the zoning
ordinance will result in practical difficulties in the use of the
property and that if the garage was constructed any closer to the
home there would be difficulty in maneuvering a vehicle into

and out of the garage.

Warren Ff~n~lzn~e~f~kary
Dated:

alley, Vic~airman
