RE: <br /> <br /> FINDINGS OF FACT <br /> <br />Marathon Petroleum Company <br />535 South Indiana Street <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals <br />on August 19, 1987, at the regularly scheduled meeting date and time. <br />The petition requested a variance from the set-back requirements <br />of sixty (60) feet to fifty (50) feet for the erection of their <br />identification sign. <br /> <br /> The Mooresville Board of Zoning Appeals having heard evidence <br />on the above captioned petition now makes the following findings <br />of fact pursuant to I.C. 36-7-4-9-18.4: <br /> <br /> 1. That the approval of this variance would not be injurious <br />to the public health, safety, morals and general welfare of the <br />community in that the request for a ten (10) foot reduction in <br />set-back was nominal and the construction in every other way complied <br />with the ordinance. <br /> <br /> 2. That the use and value of the property adjacent to the <br />property included in the variance will not be affected in a <br />substantially adverse manner and that all surrounding property is <br />business oriented and all have identification signs and the placement <br />of this sign being ten (10) feet shorter than the ordinance required <br /> <br />will not have any noticeable affect <br /> <br /> 3. That the strict application <br />ordinance would result in practical <br /> <br />on these properties. <br /> <br />of the terms of the zoning <br />difficulties in the use of the <br /> <br />property and that requiring the sign to be placed sixty (60) feet <br />from the property line would obstruct the traffic flow from the <br /> <br />gasoline islands. <br /> <br />Warren Franklin, Secretary <br />Dated: <br /> <br /> <br />
