FINDINGS OF FACT <br /> <br />RE: Special Exception Request of Hugh G. Allen <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />Wednesday, March 18, 1987 at the regularly scheduled meeting date and time. <br />The petition requested a special exception request and a request for a <br />variance to allow two buildings on one parcel of ground. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br />above captioned petition now makes the following findings of fact pursuant to <br />Indiana Code 3-7-4-918.5: <br /> <br /> 1. That the establishment, maintenance, or operation of the special <br />exception would not be detrimental to or endanger the public health, safety, <br />morals, or general welfare in any manner and found that it was consistent <br />with other uses in the area. <br /> <br /> 2. That the special exception would not be injurious to the use and <br />enjoyment of other properties in the ir~nediate vicinity for the purposes <br />already permitted due to similiar operations and businesses being in effect in <br />the area. <br /> <br /> 3. That the establishment of the special exception would not impede <br />or substantially alter the normal and orderly development and improvement of <br />the surrounding property for uses permitted in the district in that this <br />was a compatible use and in fact had been used for a used car sales lot in the <br />past. <br /> <br /> 4. That adequate utilities, access roads, drainage and other necessary <br /> facilities were already provided. <br /> <br /> 5. That adequate measures have been taken to provide ingress and <br /> egress so designed as to minimize traffic congestion on the public road and <br /> in fact that there was already a street cut present. <br /> <br /> 6. That the special exception would be located in a district where such <br /> use is permitted and all other requirements in this ordinance applicable would <br /> <br /> <br />
