Fourth, that the strict application of the terms of <br />the zoning ordinance will constitute an unnecessary hardship if applied to <br />the property for which the variance is sought due to its location on an arterial <br />street with similiar type uses. Fifth, that the approval does not interfere <br />substantially with the comprehensive plan adopted by the Civil Town of Mooresville <br />in that it is compatible with other uses in the area. The Board went on to <br /> <br />discuss restrictions and itemized the following restrictions: <br /> 1. That there will be no outside storage. <br /> <br /> 2. That all parking will be on thePryor's property. <br /> <br /> 3. That the business hours would be limited to 10:00 a.m. through <br /> <br /> 6:00 p.m., Monday through Saturday. <br /> <br />4. That the sign allowed would be no larger than 2' X 2' and no <br />higher than 4' off the ground. Further, that it would be located on <br />the north side of the driveway and only be up from April 1st through <br />September 15th with a requirement that the sign be removed annually <br />after the September 15th date. <br />A motion was then made by Tilford Bailey to grant the variance requested based <br />upon the findings of fact set out above and the restrictions set out. This <br />was seconded by Wendell Thaler and unanimously carried. <br /> <br /> The next item to come before the Board was the petition for a variance <br />filed by Allen Tutewiler and Karen Overpeck and the Mooresville Chamber of <br />Commerce on the property off of State Road 67 and Indianapolis Road. Present <br />was David Mathers, representing the Chamber of Commerce. A sketch of the area <br />in question was shown to the Board along with a copy of the proposed sign. In <br />particular the variance request consisted of a variance from the development <br />standards for a sign less than 1,000 feet from any other advertising structure <br />and a reduction of the set-back standard of 60 feet to a lesser amount. There <br />being no remonstrators present, the Board proceeded to a discussion of this <br /> <br /> <br />
