MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Mooresville Board of Zoning Appeals met on February 18, 1987 at <br />Mooresville Town Hall. Present were board members Steve Oschman, Wendell Thaler, <br />Tilford Bailey, Don Barry and Warren Franklin. Standing in for Board Attorney <br />Timothy C. Currens was Attorney Michael A. Ksenak. The meeting was called to <br />order by Chairman Steve Oschman who determined that there was a quorum present. <br />The minutes of the prior meeting were approved. The Board m~ved on to the first <br />item on the agenda which was the Manning petition which was tabled at the previous <br />meeting. Attorney Roscoe Stovall submitted the plat of the subdivision and noted <br />several restrictions in the plat, specifically, that the subdivision was to be <br />used for residential purposes only and also pointing to restriction #8 which <br />reflected that no manufacturing or other activity was to be allowed. Mr. Stovall <br />informed the Board that he was not asking them to contravene the covenants and <br />restrictions. He further stated that there wouldbe no outside storage and that the <br />Mannings would stop using Indianapolis Road as an access point. He also advised <br />that they would fill in the yard where there was a swale and mud accumulation. <br />He further advised that Mrs. Manning was willing to restrict her operation to <br />five vehicles per day and to restrict the hours of operation to daytime only. <br /> <br /> Jerry Mayfield presented a petition signed by the residents showing their <br />opposition to the proposed petition. Mr. Mayfield inquired of the Mannings whether <br />the material being used in their work was hazardous. They were informed that the <br />material is polyurethane and it was not hazardous or flammable. <br /> <br /> Chairman Steve Oschman inquired of the remonstrators as to the biggest <br />problem with the proposed petition. Mr. Mayfield responded that the property <br />was very unsightly, that there were cars parked in front of the no parking sign <br />and that there were low power lines above the Indianapolis Road ingress and egress <br />and felt this posed a safety problem. He indicated that when business interferes <br />with residential use, that something must be done. <br /> <br /> Mr. Mayfield said that if a plan was submitted in writing which the neigh- <br /> <br /> <br />
