FINDINGS OF FACT <br />Re: Variance Request of Lon Milburn <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />Wednesday, February 18, 1987 at 7:00 p.m. The petition requested a variance <br />from the Sub-division Control Ordinance to allow for the construction of an <br />additional structure on a tract of land presently zoned for multi-family dwellings. <br /> <br /> The Board of Zoning Appeals, having heard evidence on the above <br />captioned petition, now makes the following findings of fact pursuant to Indiana <br />Code 36-7-4-918.5: <br /> <br /> 1. That the approval would not be injurious to the public health, <br /> safety, morals and general welfare of the community since the <br /> arem was presently zoned for residential use. <br /> <br /> 2. That the use and value of the area adjacent to the property <br /> included in the variance will not be affected in a substantially <br /> adverse manner since the proposed use is consistent with the <br /> area's present zoning for multi-family dwelling. <br /> <br /> 3. That the strict application of the terms of the zoning ordinance <br /> will result in practical difficulties in the use of the property <br /> in that the lot size of 500 X i70 is too deep for adequate use <br /> by one structure. <br /> <br />St~v~e Oschma~, Chairman <br /> <br />, Secrotary <br /> <br /> <br />
