FINDINGS OF FACT
Re: Variance Request of Lon Milburn

This matter came before the Mooresville Board of Zoning Appeals on
Wednesday, February 18, 1987 at 7:00 p.m. The petition requested a variance
from the Sub-division Control Ordinance to allow for the construction of an
additional structure on a tract of land presently zoned for multi-family dwellings.

The Board of Zoning Appeals, having heard evidence on the above
captioned petition, now makes the following findings of fact pursuant to Indiana
Code 36-7-4-918.5:

1. That the approval would not be injurious to the public health,
safety, morals and general welfare of the community since the
arem was presently zoned for residential use.

2. That the use and value of the area adjacent to the property
included in the variance will not be affected in a substantially
adverse manner since the proposed use is consistent with the
area's present zoning for multi-family dwelling.

3. That the strict application of the terms of the zoning ordinance
will result in practical difficulties in the use of the property
in that the lot size of 500 X i70 is too deep for adequate use
by one structure.

St~v~e Oschma~, Chairman

, Secrotary
