MINUTES OF THE MOORESVILLE BOARD OF ZONING APPEALS

The Mooresville Board of Zoning Appeals met on January 27, 1987 at

Mooresville Town Hall. Present were Board Members Steve Oschman, Wendell Thaler,
Tilford Bailey, Don Barry, and Warren Franklin. Standing in for Board Attorney,
Timothy C. Currens, was attorney Michael A. Ksenak. The meeting was called to
order by Chairman Steve Oschman who determined there was a quorum present.

The Board proceeded to the first item on the agenda which was the reorganization
for the year 1987. Wendell Thaler moved to have the same officers for the year 1986
renominated for the year 1987, namely Steve Oschman as Chairman, Wendell Thaler
as Vice-Chairman, and Warren Franklin as Secretary. The motion was seconded by
Tilford Bailey and unanimously approved. Prior to proceeding to the next item
on the agenda the Board approved the minutes of the prior meeting. The Board
moved down to the next item on the agenda which was the petition of Labsonics
for a variance to allow the construction of a temporary modular office building
on their parking lot at 236 E. Washington Street in Mooresville. The Board
finding no one present at that time proceeded to the next item on the agenda
which was the petition of the Indiana South District of the Wesleyan Church
requesting a variance to sell less than 20 acres of land for the purpose of
constructing a single family dwelling. Present to speak on behalf of the
petition was Harry Cloud, a realtor at Century 21 who was there on behalf of
the prospective buyer of the property, namely, Robert Newman. He advised that

Mr. Newman was proposing to purchase the property in question from the petitioners
which was a 9.4 acre tract of ground in order to build a single family residence.
He advised that KOB Enterprises had several tracts of land divided in 1984 into
separate lots without going through the proper subdivision ordinance or by
requesting a proper variance. He indicated that the contract purchaser now desires
to avoid the subdivision control ordinance in order to build this home.
