FINDINGS OF FACT <br /> <br />RE: Variance Request of Mooresville Public Library <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />Wednesday, September 17, 1986 at the regularly scheduled meeting date and <br />time. The petition requested a variance to allow the construction of a public <br />library on said real estate which is classified A-Residential with the proposed <br />type of use requiring a LB zoning classification. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br />above captioned petition now makes the following findings of fact pursuant to <br />Indiana Code 3-7-4-918.5: <br /> <br /> 1. That the approval would not be injurious to the public health, <br />safety, morals and general welfare of the community and in fact felt this would <br />be a great asset to the community. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br /> in the variance would not be affected in a substantially adverse manner, and <br /> that the structure should be an asset to the community and the adjacent properties. <br /> <br /> 3. That the need for the variance arises from some condition peculiar <br /> to the property involved due to the slope of the property and the type of <br /> development that would be necessary to fully use this property being limited to <br /> this type of structure versus breaking it down in residential areas with the <br /> resulting drainage problems and portions of the ground that could not be used. <br /> <br /> 4. That the strict application of the terms of the zoning ordinance <br /> would constitute an unnecessary hardship if applied to the property for which <br /> a variance is sought in that a local business classification would not be <br /> compatible with the surrounding residential uses. <br /> <br /> 5. That the approval does not interfere substantially with the <br /> comprehensive plan adopted under the Indiana Code in that this is a compatible <br /> use with the prior location of the neighborhood and proximity to schools and <br /> residential uses. <br /> <br /> <br />
