Re: <br /> <br /> FINDINGS OF FACT <br /> <br />Larry W. Cooper and Rebecca S. Cooper <br />204 East High Street <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />Wednesday, August 20, 1986, at the regularly scheduled meeting date and time. <br />The petition requested a variance from the development standards. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br />above captioned petition now makes the following findings of fact pursuant to <br />Indiana Code 3-7-4-918.5: <br /> <br /> 1. That the approval would not be injurious to the public health, <br />safety, moral or general welfare of the conmaunity in that all of the lots <br />in this area were small and that the overall coverage of improvements on <br />the land was not such as to create any difficulties or threats to the public <br />health or safety, morals or general welfare of the area. <br /> <br /> 2. That the use and value of the area adjacent to the property <br />included in the variance would not be affected in a substantially adverse <br />manner due to this being the size of most lots in this area of Mooresville. <br /> <br /> 3. That the strict application of the terms of the zoning ordinance <br />would result in practical difficulties in the use of the property in that all <br />of the set-back requirements of the ordinance could not be met with a house <br />and garage being placed on this lot. <br /> <br />Warren Franklin, Secretary <br /> <br /> <br />
