FINDINGS OF FACT <br />MOORESVILLE BOARD OF ZONING APPEALS <br />RE: Hosten Bible, 130 N. Indiana Street, <br /> Mooresville, Indiana <br /> <br /> This matter ..m. before the Mooresville Board' of Zoning Appeals on <br />Wednesday, September 18, 1985 at the regularly scheduled meeting date and time. <br />The petitioner-requested a variance from the degelopmeflt standards of xhe <br />property described in the attached legal description to the petition. In <br />particular, the request was to allow for reduced Set-backs on the Morgan Street <br />side and south aide along with a request for m~nimum lot width from the 2: 1 <br />standard set out by the Mooresville ordinance, for minimma lot area per dwelling <br />standard required by the ordinance of 3500 square feet ~'to 2500 square feet and <br />for a variance from the parking standard of-the town requiring 2 spaces per unit. <br /> <br /> The Mooresville Board of Zoning Appeals ,' having heard evidence on .the above <br />captioned petit, ion now makes the following findings of fact pursuant to Indiana <br />Code 36-7-4-918.5: <br /> <br /> I. Setbacks <br /> <br /> A. That -the approval will not be injurious to the public health, <br /> safety, morals and general welfare of the community in that the <br /> setbacks as set out are not out of character with the neighborhood <br /> in which the structure would be located. <br /> <br /> B. That the use and v~lue of the area adjacent to the property in- <br /> cluded in the variance will not be affected in a substantially adverse <br /> manner in that said structure will not he out of character to the <br /> neighborhood in question and would fit within the character of current <br /> setbacks. <br /> <br /> C. That the strict application of the terms of the zoning ordinance <br /> would result in practical difficulties in the use of the property in <br /> that as the property is zoned ';to build a structure that ~ould financially <br /> and structurally fit on tltts' parcel of ground without a variance would <br /> <br /> <br />
