FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />RE: <br /> <br />Arvin M. and Mary Lou Hopkins <br />Property located at 622 State Road 267 <br />Mooresville, Indiana <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />Wednesday, June 19, 1985, at the regularly scheduled meeting date and time. <br />The petition requested a variance from the use standards of the property <br />described in the attached legal description to the petition. In particular, <br />to allow the petitioners to continue the operation of E-Z Way Rental and Sales <br /> <br />to continue the business uses as follows: <br /> 1. Tool rental business <br /> <br /> 2. Sale and repair of small engines, such as lawnmowers and pumps <br /> <br /> 3. Leasing of trucks and trailers. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br />above captioned petition, now makes the following findings of fact pursuant <br />to Indiana Code 36-7-4-914.4: <br /> <br /> 1. The Board first found that the approval would not be injurious <br /> to the public health, safety, morals and general welfare of the <br /> community in this location. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br /> in the variance would not be affected in a substantially adverse manner <br /> in that the property was surrounded by the gravel pit area and the <br /> residents were buffered by the highway and large front yards. <br /> <br /> 3. That the need for the variance arises from a condition peculiar <br /> to the property involved, that being the fact that it is apart <br /> of the partial currently being mined for gravel and sand. <br /> <br /> <br />
