That the approval does not interfere substantially with the <br /> comprehensive plan adopted under the 500 series of the Indiana <br /> Code for the Civil Town of Mooresville. <br /> <br /> A motion was then made by Paul Walters to grant the variance with the <br />restriction that the sign be limited to 5 square feet and a minimum of a two <br />foot setback, that parking be provided for a minimum of 2 cars with a one chair <br />restriction as to the beauty shop operation and further that the operator must <br />be June Cowden and no one from outside the residence. This was seconded by <br />Wendell Thaler and unanimously carried. <br /> <br /> The next item to come before the Board was the petition for a variance <br />filed by Arvin M. and Mary Lou Hopkins on the property located at 622 State <br />Road 267, Mooresville, Indiana requesting a variance to continue the operation <br /> <br />of E-Z Way Rental and Sales to continue the business uses as follows: <br /> 1. Tool rental business <br /> <br />2. Sale and repair of small enginea, such as lawnmowers and pumps <br />3. Leasing of trucks and trailers. <br />Mr. Hopkins was present by counsel David E. Lawson and also present were Randy <br />J. and Denise C. Beck, who run the E-Z Way Rental operation. Attorney Lawson <br />advised the operation had been in effect since 1980. He then entered into <br />evidence as an exhibit a copy of the contract entered into by the Civil Town <br />of Mooresville and Azvin M. and Mary Lou Hopkins regarding lands adjacent to <br />the property in question along with a statement that this property would be <br />rezoned or a variance sought within sixty days from the passage of the contract. <br />Mr. Lawson then entered his exhibit "2" which showed a drawing of the 1.24 acre <br />in question. He also stated the reason for the request for a variance in that <br />truck rental zoning would require I - Industrial zoning which they felt would <br />be inappropriate to this area.
