FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS
IN RE: Variance application 3-1984
Petition of William L. Cox and Linda L. Cox
1148 Westwood Drive

Petition for a variance from developement standard in particular side set
back from 12 feet to 7 feet and rear set back from 40 feet to 17 feet for the
purpose of construction of a garage. The Mooresville Board of Zoning Appeals
having heard evidence on the above captioned petition now makes the following
findings of fact:

1. That the approval of the petition will not be injurious to the

public health, safety, morals, and general welfare of the community;

2. The use and value of the area adjacent to the property included in
the variance will not be effected in a substantially adverse manner
due to the location and similar set backs currently existing in the
area; and

3. The strict application of the terms of the zoning ordinance will result
in practical difficulties in the use of the property, in particular making
it impractical to construct a garage and use rest of property to full

compliance is made with current standards.

Steve Oschman,

, Secretary

Chairman

Dated:
